In September of this year I sold a 1988 Chrysler New Yorker for $1100 and allowed the individual to make payments each week. The orginal price was $1400 but I told him everything that needed to be fixed (that I knew about) and that it needed an oil change and even took $300 off the price. He paid $300 down. About 2 weeks later he called and said that the car blew a seal and asked if he could postphone payment so he could get it fixed, I agreed and then about a week later he called me to tell me to come and get the car because it threw a rod and he was not going to pay for it nor the repairs on it. The big thing is that after the seal blew he continued to drive it which caused the engine to spit out the oil and lead to it throwing a rod. Recently, he called to tell me to come remove the car from his yard and that he could sue me under the lemon law. Can he sue me?
Also, can I sue him for the outstanding balance on the car or take the car back and sue him for the repairs? The bill of sale that I provided him states that he was to pay $300 down and $200 a week until the car was paid for.
