Yesterday I was informed by a police detective that the woman who lives below me was raped in her apartment by an unknown intruder who had keys to the building. At this time I was also informed that the same apartment as well as 1 other apartment in the building (there are 4 total) have been robbed recently-- obviously, no one told me this previously. I no longer feel safe in my own home and am wondering if I can legally break my lease, which would be up at the end of september. Any help would be greatly appreciated

Most states have a residential landlord tenant act that requires landlords to keep common areas clean and safe. I assume you're in NY from your name.

At a minimum, this means changing the outside locks when keys disappear or the landlord knows that someone who doesn't live there has keys. If your bldg is young enough, landlord also ,ust include installing self-locking doors & and intercom. NY Consolidate Laws, TITLE 2: FIRE PROTECTION AND SAFETY, Sec. 50-a.

It may also include heavier doors, or video cameras. Failure to provide adequate safety can result in criminal punishment and/or civil liability for crimes committed on tenants, and/or justify breaking a lease. Talk to your local tenants union and ask about what your state requires.

This is not legal advice and you are not my client. Double check everything with your own attorney and your state's laws.
