What is the name of your state (only U.S. law)? Indiana

I live in Marion County, Indiana. My son is 14 months old. His father and I were never married and split in November 2010 because I couldn't take his abuse anymore. He was arrested on 3 felonies and 2 misd, all having to do with domestic battery/strangulation for attacking me and choking me while holding our son. I have a court-ordered permanent protection/no contact order for 2 years for my son and I. He is out on bond now and he has requested a jury trial which is in March 2011.

Since the split, I have not heard from him or anyone in his family regarding my son. No money (he was the financial provider, I have nothing), no Xmas presents, NOTHING. I know he can't contact me, but that doesn't stop his family for sending money and I've seen him in court, with our lawyers and judge present, and he or his mother could have brought a Xmas present, and didn't.

My son has 1 first name, 2 middle names and his father's last name. His father is listed on the birth certificate and signed the paternity affidavit at the hospital. I want to drop my son's 2nd middle name (my ex's father's name) and change my son's last name to mine.

I guess what I'm asking is, is this even worth the effort? I know his father will be served with the petition for name change and he will show up in court (because he will do anything to hurt me, including using my son). I can't afford a lawyer, so I've been looking into pro-bono attorneys. I'm just wondering if it's worth the effort. Do you think a judge would grant it??What is the name of your state (only U.S. law)?

I would like to know why you think his family owes you any money or gifts for the child. Lady, your sense of entitlement is skewed a bit.
