Can I change states?

I'm living in Md and my support order is in Pa. because it was originally filled there where my daughter still resides. I am currently trying for a reduction in support due to health issues and not being able to work full time. We already went through the first conference and my doctor supplied legal documents stating my reason. My support has been reduced to reflect my reduction in pay.By the way I did this via telephone because I live 4 hrs away.Of course my ex appealed the outcome. I had the hearing set up and they wanted to do a phone conference with my doc. I set that up also.2 hrs before the hearing my lawyer calls and says they want a continuence because they want me and my doc to be there in person.Trouble being my doc goes in for his 4th hip operation in 2 weeks.Last time he was in the hospital for 4 months due to infections. So now they say he can do the phone thing and I need to give them a date when he'll be available.Well I can't tell them that.They still want me to be there in person.I think they want to show the master yhat I look fine? Which doesn't mean I feel fine...DUH..Anyway heres my question..Can they make me make the 4 hour drive even though my health is an issue? Second,can I have this case moved to a Md. court? I have chronic chrones disease and have undergone a major operation last year.

No, you can't move the case. But you can appear by telephone, in most states, if you file for telephonic appearance in advance. Check PA's courts to see if you can appear that way.

The problem is I already had the hearing set up via telephone and 2 hrs before the hearing my lawyer called and told me that the ex's lawyer was demanding I be there in person!! So it was put off for now. Can they demand this?

I don't know -- what did your attorney say?

No, you can't move the case. But you can appear by telephone, in most states, if you file for telephonic appearance in advance. Check PA's courts to see if you can appear that way.
I don't think though, that telephonic appearance has to be granted when requested.

I think it's probably a valid request w/a clear purpose if the judge is pushing to have him present.

I know several people w/Chron's... not one of them works less than full-time.

Entirely so -- it does NOT *have* to be granted.

He said it was the opposing attorney, not the judge. If it was the judge, I'd have told him to get his butt there, in person, pronto!

Can you get documentation from the doctor that you cannot travel that far?
I would doubt it very sincerely.

My step-father has chron's, hep c. and an enlarged spleen. He's on 100% disability due to the liver disease and enlarged spleen (cannot lift more than 8lbs)... and he has to routinely travel 4 hours just to go to the specialist in Omaha NE... the nearest transplant center.

Sounds like I'll be making the trip.I also know people w/chrones who work full time but not all cases are equal. Stress is the #1 factor and if you read my other posts about whats going on with my daughter then you would understand why my chrones is so bad...

I was diagnosed with Crohn's disease seventeen years ago. (that's the correct spelling, BTW.) I've had three resections of diseased intestine, losing several feet of intestine in the process. I get intestinal obstructions every bit. Oh, and I've got a hernia down my abdomen along the incision from the last resection. I'm due to have it repaired in January.

I take immunosuppressives, and Remicade, as well as other drugs to deal with the related arthritis and spondylitis.

I work full-time in a stressful job, do lots of volunteer work, and I'm a mother. In addition to all that, I'm about to start teaching a class on Saturday mornings.

In my office, we just love it when one of us gets a client who claims to be disabled and unable to fulfill the terms of their probation or pay fees and costs. If I can be a probation officer and do all that I do, they should be able to do SOMETHING! It really ticks off one of my fellow juvenile officers. You ought to hear her complain when a client's parent says he/she is disabled, but still has the ability to do all sorts of non-work activities.

If I can do all this, with active CD, I think you could probably work to support your children. There are days I don't feel like going to work cause I feel ooky, but I go. There are people depending upon me, just like your daughter depends upon you for her support.

BTW, I hate this &&*^&%^ disease.

I'm glad you are superwoman,I have no problem supporting my daughter,in fact when I worked for Bethlehem steel in Indiana I was making close to 70,000 a year and paid a hefty support for years.When they went bankrupt in 2002 I lost that job.I then moved to western Md. Well there is no industry here that pays near that.I moved here to live with my now wife who lived here all her life. I got a decent job for this area which pays me 20,000-25,000 a year I continue to pay that support off my steel wage because according to the courts "I have potential" do the math!!!I have NEVER missed a payment!I also pay 60% of her private school at 6,500 a year,also I'm ordered to pay 60% of her doctor bills.And heres the real kicker..I tried to get my daughter on my health insurance but they declined her because her mother had put her on anti-depressants at the age of 10. So it was mom's duty to get her coverage,which she did. She got her covered under the state coverage. But the problem is her mom takes her to a psychologist who doesn't accept that coverage making me responsible for 60% of that bill. I tried to get a loan for a house for 39,000 and was turned down because I have no real income after all I pay to my ex. And my credit rating is 802.Also one last thing.My ex owns a 2007 Lincoln,lives in a 500,000 home,and claims she makes 9,000 a year on her business.Whats wrong with that picture?The courts are destroying this country with there bias against us men..

Have your attorney suponea her tax returns, including the business, for the last three years. If the business is paying any of her personal expenses, like the car, that has to be added into her income.
