Can I enter?

What is the name of your state? MI
In the middle of September I had a new tenant move in to my flat. She paid the security deposit and the pro rated rent for September. She was on a month-to-month lease and hasn't paid anything else since she moved in. In the beginning of November I served her eviction papers saying that she had 30 days to move. I have been trying to contact her through letters and showing up at the property with no responds. I have good reason to believe she has abandoned the property because there is a foul smell coming from the place and my other tenants haven't seen or heard her for weeks. My lease states if you abandon the property that I may enter. My question is do I have to wait for the whole eviction process to be finish or can I enter the flat now assuming that she has abandoned the property?

**A: enter the property and make sure the CSI team is there.

In other words, she may be unable to answer the door. Or do you think the foul odor is from leftover Halloween candy?

If the odor os that bad by all means take a phone with you and you open the door if you find out that your tenant has died call the police ASAP . such things arent unheard of . If you find nothing wrong other than just a bad bad pigsty leave a note on door saying you entered unit on that day to emergency inspect because of odor .

Post a 24 hour notice to enter on the door, Then you may enter to check the unit.

**A: what? No advance notice need be given in this particular circumstance and L can enter immediately.

Entry without notice is only for emergencys, an odor is not an emergency she may have just been cooking cabbage, or just raising pigs and not wanted to answer the door. If the odor had been coming from the unit for several days one more day just to make it legal wouldn't hurt, now would it?

Of course it would.

In your scenario someone bleeding profusely would have to wait until I posted a 24-hour notice on the door and then waited that 24 hours to get medical attention.

Or haven't you ever smelled coagulated blood?

HG is right. This story rises to the level of ordinary care and concern and that is all that is needed, NOT an emergency.

**A: you still have no clue as to what you are talking about? One more day just to make it legal? I already gave the writer advice and you are still contradicting it.
