Like one other person on here I am NOT satisfied with my realtor. He has not advertised our home properly in the last 3 months, we haven't had many viewers, he has not done an open house, we have to call him for updates and info, we waited two months for a copy of our agreement, he has only put one pic on the net that doesn't show the good in our home, he didn't describe any of the benefits or improvements to this home, and so we sought the advice of some other realtors. All have said that we should be able to be released from our contract in writing. We have talked to the realtor and he does NOT want to release us, yet he's not doing his best to promote the sale of our home. He has really messed things up for us. He is not rendering his services like he should. By Law can he keep us bound for the next 3 months? He told us it was illegal to talk to anyone else about our home. How can that be? Now that we confronted him we fear he won't show our house at all if we are bound to him to be spiteful and we can't afford to stay much longer, it's too expensive, we will fall behind in payments. Help Please!!! I need some answers and peace of mind.What is the name of your state?

I'm sorry I don't understand what you mean about my "contract language". I just want a direct answer on whether I can terminate or not. 2 have actually viewed the contract.

Contract - An agreement between two or more parties, especially one that is written and enforceable by law.

How in the world can we answer you if we cannot review the contract language? If you want a more complete answer you can pay someone to beat the details out of you.

I will ask you a question and see if you can answer me, I left my house and went to work. Now what time of the day it is and I demand direct answer!

Somewhere in the listing contract it will explain what happens if you terminate the contract early. Read each paragraph carefully.


The listing on your home belongs to the company and not the Realtor that listed your property. Call the manager/broker, set up a meeting to discuss your concerns and the Realtor that you "hired". The manager/broker can assign another Realtor to you to market your property or if all else fails, he/she has the power to terminate your contract. I would suggest that you approach "the big boss" in a calm, civil, non accusatory manor.

Thank You for your answer to my question without being arrogant or nasty, PGHrea. I truly appreciate it. As for averad, there is no need to be rude! I am educated thank you and you've been a jerk since the beginning. If you couldn't help me then you shouldn't have replied and wasted both of our times!

You still haven't posted the contract language pertaining to the termination of the contract. So you still have not received an answer to your question.

I_m not going to sit here and hunt and peck for details, when you have the answer on the paperwork you signed. All you needed to do was look at the contract and type out the language on the contract that pertains to termination/cancellation.

I also gave you a link to your state laws and gave you the page numbers for the laws definition of misrepresentation for realtors (which you could read and determine if he has broken any laws).

Some place in your contract there is a section that addresses what happens should you decide to terminate the contract. You need to tell us what that says before anyone can advise you.

My question: You state that the real estate agent is not doing his job. Where are his job functions out lined? The market (nation-wide) is slow right now. What are your expectations?

There is no place in the 4 page "Virginia Regional Listing Agreement-Exclusive Right to Sell" does it even state how we would terminate/cancel, under what circumstances and what we would be required to pay if we did terminate. I have read the contract numerous times! If I would be able to email a copy to someone I would be more than happy to do so. It would be too much to type it all.

Make an appointment with the manger/broker/owner to discuss your issues.
