We live in San Diego CA, we gave a deposit of $400 for an apartment which the manager said she was going to try an have ready for us Feb. 7th We just found out that she has not yet done anything to the place and from what she said everything needs to be replaced. She had a walk through with the old tenant Jan. 14th and she saw what needed to be done then. I feel she's not responsible enough and if she's doing this to us now what kind of management are we getting ourselves into. I asked her for our deposit,but she said she told us it was not refundable..which is not true she said that was to hold the apartment. This woman said she had a lot of people in line that wanted this place and she has gone out of her way to hold this place for us. I just don't understand how did she go out her way..the place is not loosing money because the place is not even done to rent! We never signed a lease, and we have not seen the place were we were planning on living. We made arragements for SDG&E, phone, cable, and even gave notice to our storage place..and we can't move in. She refuses to give us a date when..she only says she's going to try her hardest!! I'm not sure if we have a case here..I don't want to loose my $$$.

You definitely have a case. I also live in San Diego and am going through the same thing.(read my letter a week or so ago) Check out Calif civil code 1950. I had to take my situation to small claims, but maybe if you show her the civil code, you wont have to hassle with court. Good Luck
