I have reecently signed up for merchant services through a company located in Spokanne WA. Not only once but twice now I have been overbilled on monthly service charges. Both times I have been told (and have proof) that the merchant service company said that they would refund the overcharged amount as well as overdraft charges that I have incured due to their error. My question is: legally can the contract be considered broken due to their inability to bill me the amount specified in the contract? And/or what are my options for recovering the refund that is due and has been promised to me.

Sue in small claims court for the refund. It costs $35 in Washington. Send them notice that you're terminating the contract for multiple material breaches which the company has failed to cure. This is just a guess, since I can't read the contract from here.
