Can I get reimbursed for material and registration fee?

What is the name of your state (only U.S. law)? California

I made an application in February for my child with a private school for their Pre-K program. I then cancelled my application in April and asked for my checks back. I got the checks for the tuition back but I did not get a $200 check for registration fee and $350 for material fee.

They are claiming that their contract says that those two checks are non-refundable Even though the school year starts in August.

Here is the actual paragraph from the contract that talks about all the fees.
"The basic full time rate will be $x/year/student full time. Parents agree to pay the full year's tuition total upon admission or choose the option of installment plan payment which works as follows: provide 10 post-dated checks starting July 1st, 2010 through April 1st, 2011. Registration fee and material fee are also due upon admission. NO REFUND EITHER FULL OR PARTIAL IS AVAILABLE in the event a student withdraws or is dsimissed from school."

Does admission means filling the application and giving them checks or actual admission to school? because my kid was never admitted we cancelled the application before they made their selection. Please let me know if I can get this money back or they have a right to keep it.

You could try. You could argue that your child had not been "admitted" yet - and you withdrew the application, so you are entitled to the return of at least the materials fee. The registration fee is more iffy since you DID submit the paperwork to register.

What date did you withdraw the application? How did you do it? By phone, in person, by letter, by registered mail - how?

What date did they make the admissions?

Who did you talk to, and what exactly did they say?
