can i give grandpa custody?

What is the name of your state? ny i became pregnant s the result of being raped, the man who raped me pleaded guilty to reduced charges, and is curently serving time in prison. my baby is due is a little over 6 weeks, and i want to make sure he can NEVER have any legal claim to her, so i was thinking of giving custody to my father. can i do that, and can he come back when he gets out of prison and try to get parental rights to her? i dont want him to have anything to do with her.

Go get yourself a consult with a local attorney. In many states a rapist has no legal right to claim parental rights regarding a child produced of rape. In those states the rape conviction automatically terminates any parental rights. I don't know if that is the case or not for NY...but a consult with a local attorney is the best way to get a clear answer.

In any case, giving custody to grandpa wouldn't make a difference. A third party having custody doesn't sever parental rights. Grandpa adopting the child would.

I see the post *waves to Kelly* as a way to warn people that this may or may not be the local troll, so proceed with caution. It is normally effective because Kelly will ignore this salutation, while a legitimate new poster will ask, whose Kelly.

It's not like I came on here and used a bunch of profanity aimed at the OP.

I understand your point...but when one regular initiates the "K-dar" it tends to bring out everyone.....and often before the OP has a chance to respond to anything. I think that we have an obligation to take each new post at face value....

That is simply my opinion...you are free to have another. Its just that I am nearly certain that we have driven off legitimate posters by accusing them of being Kelly....just because their situations wheren't run of the milll.

It bothers me...sorry....

I understand that it bothers you. I think that most of the regulars here are very aware that you do not feel we treat new posters with the dignity and respect that they deserve.

And when someone goes on an unwarranted Kelly rant it bugs me as well. But a *waves to Kelly* or a *k-dar*, to me is just a warning a proceed with caution. Personally I find calling someone out for it on a thread to be more distracting to the op's issue, than the post itself, because now OP has to wade through all of this little back and forth that could have been handled in PM, to get to their legal advice.

If you can PROVE the RAPE , you can give guardianship to the GRAND , IF you don't care to take care of YOUR Child , through the Court , Visit one soon , same day process , but be prepared to pay CHILD SUPPORT , or are you Indigent ?
