Can i kick out my roommate if we have no rental agreement and only paid for a (1st) month, and she has not paid for 2nd month, she has not been in this location for 60 days only 45?


can i throw her stuff out, she is never here her stuff is, she refused to pay...

She's considered a tenant and legal occupant of your residence. You have to follow the proper legal procedures and evict her through the courts. Start with a "Pay or Quit" notice. Look up eviction procedures for your state to find the proper notices and lear the right way to do this.

If you toss her property out, you'll be looking at a lawsuit and having to pay her for her damages you caused.

I agree that you should NOT throw her stuff out, you could face a judgment for damages if you don't do it properly.

I disagree of what to do though. Has she been gone 20 days straight? does she have a room with her stuff?
