can i MOVE AWAY from ABUSIVE father

HELP!!! :eek: I want to move away from an abusive , darn near deadbeat. We're not married, there's no formal court order(s), paternity test was not done, he signed BC but hasn't been formally filed. He's behind in social service ordered CS, (don't think he's payed a penny). I've ALWAYS been the one to take care of the baby. I have a job offer in another state which will have benefits from day one, apt set up, daycare arranged, transportation. He's abused me throughout my pregnancy, post-partum, in front of the baby, even while I was HOLDING the baby. We NEED to get away. I've tried to make a life here and encourage a relationship between them but to no avail. He's in and out of jail, with and without a job. I'm trying to make a life for my baby and I. Can we move? I understand if we do we could open up his right to file to est paternity or petition the court, but he hasnt given a d*^& about her in the same city so why would he suddenly care? CAN WE MOVE? PLEASE HELP. I NEED SOME ANSWERS. I've tried to answer other people's questions and only 1 person answered mine, (thanks to you) please help me this time. If I can go, I need to know so i can take this job. THANKS

You can move any time you want to.

If he wants to file for paternity or visitation let him. He will have to come up with attorney's fees and filing fees and money for a paternity test if paternity is in question.

That isn't a very good answer. Its all true...but you left out some important information.

Yes, the OP is free to move. However, as you said dad is also free to file for custody/visitation in the current home state....and also free to ask the judge to order mom to return the child to the jurisdiction.....and its highly possible that a judge would do just that.....no guarantee...but highly possible.

In the end, I think that mom would win permission to move, because if mom is giving us accurate info it would be almost impossible for the judge to justify giving dad primary custody........but her life and her finances could get pretty darned complicated in the meantime.

Mom basically has two choices here. She can either move, and hope that dad doesn't try to file anything until she has lived in the new state for the amount of time that it takes to establish legal residency (usually 6 months).

Or, she can go ahead and file for custody in the current state, and also ask for permission to relocate.
