My response:

Well, the presumption here is that you had some sort of a contractual relationship going on. If that's the case, then no, mental anguish is not compensable under a contract relationship.

However, I am willing to read further details from you, and if you do, I may have some other remedies that you may pursue.

First and foremost, thank you "I AM ALWAYS LIABLE" for the kind assistance. Here is the story in a nutshell: I'm talking about a moving broker - a company which I hired to contract services to relocate my vehicles and household goods across the US. On the episode of the vehicles, a certain employee did NEVER get things right and I had to go through the headache of having to solve THE SAME PROBLEM over and over again at least 4 times because of the "capabilities" of that individual. That wasted my time at work (in the least of the problems). My anguish was just beginning.... The vehicle transporter company showed up 10 days ahead of time to pick up one of the cars and all the other dates for both cars were always wrong. While in transit, my vehicle had to stop and was held in another state (for two days) because another client (of another delivery) did not have money to pay his/her bill. That forced me to incur car rental expenses awaiting for my car to arrive. Once the second car arrived, the same "capable" employee of that moving broker virtually held that vehicle hostage in a depot, (keep in mind that they had already been fully paid) by denying to furnish me with the address where the car was in my state so I could pick it up. They alleged that only his company could contact their transporter. I was denied names, phone numbers and location of my car after it had arrived even I threatened them to send the police over their office for literally taking my car and denying the return of it. The whole process of the move was a painful nightmare. Needless to say that before I had paid anything to them, my phone calls were promptly returned and they were always available to speak to me. After my money was on their hands, by some magic strike, they were on vacation for entire weeks, never returned my calls nor were available to address my discontent or issues. And the households move.... ohh.. the households move.... where should I start. This broker company is headquartered in Miami, FL. I was having the move made from Sacramento, California to Atlanta, Georgia however, currently, I am living in Dallas, Texas. Initially, the movers were extremely rude to my wife in Sacramento, while I was in Atlanta dealing with the new life. They told her that while "they were packing" she "did not need to stay inside the home". Besides trying to come up with every trick to enhance our expense tab. One of their tricks was to unpack and re-pack many of the boxes we had already sealed, alleging they were not suitable for long moves. At the end they came up with an additional $700.00 of packing expenses which I, in the first place did not OK or authorize. Of course I refused to pay and did not. However, the nightmare of dealing with the broker company was not over as promises were broken, deadlines were not met, I spent a lot more money just to patch wholes in the gaps they left in their move; horrific and careless, disrespectful customer service and the most pathetic services I ever hired from anyone in my life!! My situation was temporary and I was staying at hotels, renting cars, etc...
This is the story and although a long dissertation, believe me, it's a compressed version of what I went through. I am now investigating all means available to me to seek compensation for the anguish I lived while doing business with them, that should not be limited to monetary, and personal as well as alert the consumer public about this company and their practices, as they are a large national mover who will certainly hold pray another victim as I type. Possibly report their endeavors to the BBB in Miami, and all else I can do. It’s embarrassing and shameful even to speak freely that I could have dealt with such disastrous individuals.
