What is the name of your state? Texas

I applied for a Tourist visa to a country in South America. The visa process took a long time. So I withdrew my application after 4 weeks and requested that they send me back my passport. It's been a week since the day they promised to send me the passport, but I am yet to receive it. I am not sure if they might have lost my passport. I have spoken on the phone numerous times, but they told me that it will be mailed today blah blah blah.

On what grounds can I sue them? Is it possible at all, or are they protected by diplomatic immunity?Seems like I will be losing my vacation.
