Can I sue an individual for going into my personal email and then giving those emails to the police?

I'm not the most stand-up guy but I'm trying.

I was trying to scam HomeDepot on a job they did for my business. I kind of sabotaged it. Thing is a friend who I told this to went into my email and printed out the emails of me and someone else discussing how to do this and gave them to the police. He had my login information because he had once been an employee of mine and would answer some correspondence for me.

My question: can I go after my friend financially for going into my personal email without telling me?

Google "Unclean Hands". That will explain why you won't win in court.
 
You admitted that you were trying to scam Home Depot and your friend gave that information to the police!
I would be more concerned about getting a knock on your door from the police than trying to get money from your friend.

You told your friend of your criminal activities. He could have gone to the police straight away and reported what you had told him. The police then could have obtained the e-mails anyway with a search warrant. So the outcome would be the same either way: the police would know of the crime and have the e-mails that your friend gave them. As a result, I'm not seeing any financial damages you suffered from this. You cannot successfully sue for money you failed to get from a crime in any event. Criminals have long done themselves in because they couldn't keep their mouths shut about their activities. You aren't the first and won't be the last to be done in by loose lips. I suggest you not talk to anyone else but your lawyer about this criminal episode. And yes, it would be a good idea for you to get a lawyer lined up now so you know who to call should the cops arrest you for this.

Remember the advice of Yoda: “Do. Or do not. There is no try.” Be a stand up guy. You know that stealing (scamming) from others is wrong, so don't do it. It actually should not be that hard. If the problem is that your associates are all criminals and they lead you to join in their criminal ways then cut off your relationship with them and find friends who are truly stand up guys. If you continue down the path of stealing from others you may end up spending a good deal of time in prison for it. Is that really the life you want?
