Can I sue AT&T for overbilling past the amount I authorized them taking.

What is the name of your state (only U.S. law)? I am currently residing in California.

The issue began December 24th, I got paid and decided to pay my overdue balance at AT&T for 136.46 but i had an overall balance of 306.96 but only the 136 was due, I told this mutton-head of a wench to pay just the past due balance of 136.96 and not the entire thing because i had shopping to do. To my dismay she completely ignored my request and billed me for the entire 306 the day before christmas when i still had buying to do. It is now almost a full week later and the reversal has not gone into effect, and so ultimately I will be unable to buy gifts this year and I have had so many issues from them. I want to know if i can sue directly to either have the original agent fired immediately or receive a fair settlement for my time trouble and money or maybe just a clean breach of contract for me and my girlfriend without paying our balance OR termination fees. We have had NOTHING but trouble from AT&T and im ready to get something back from it, please tell me what my options are and the likelyhood please.What is the name of your state (only U.S. law)?

Are you asking what can be done because you didn't want to pay your entire contracted balance?

Yes I used my citibank mastercard, obviously I was not trying to get out of paying alltogether, I merely waned to pay the past due balance and not the part that wasnt past due, the 2nd payment wiouldnt become overdue until the 10th of january when i got paid again. I know thre is something i cando i just need the guidance to make these criminals pay.

You are under the impression that a bill isn't due until it is past due.

that would be incorrect.

The amount you owed on December 10th was removed from your account, right?

You have no recourse.

There is no way I have no recoursew because i only authorized payment on th past bill, something that is allowed per my contract ads long as i dont pay after shut off date. Even if i owed the full 300 i have to authorise payment of it, and i only authorised 136, which is perfectly fair, what they did was basically steal next months payment, if you think i have no recourse do not respond as i completely disagree with yu, anybody who has the right idea please respond. I thank all who read and responded but u are just flat wrong about my options.

Tell you what. Please go and pay to consult with local counsel who will advise you further.

Listen, I'm sorry I responded like bI did, I just cant accpt there is nothing i can do, this is definately a lawsuit over damages and negligence. They had an authorization for 136.46 not a penny more, and they quite literally went ahead and withdrew more than double my authorised amount, which is very easily understood to be theft. I thank you cfor responding, but I need to know something, anything I can do to respond tto this insult.

Seriously - though I understand your frustration, you have no legal recourse here.
