My husband and his ex have been going through family court over child support and vistiation for years, she unfortunately is very unhinged and not rational at all, one of their children passed away last year from a terminal illness. Every time she files with the courts the paperwork is full of accusations against me for things that do not even relate to her case. I have just filed a declaration with the family court to note my concerns about the situation and refute (with solid evidence) that this women is making false allegations. On what basis can I take her through civil court for libel?

communications in legal proceedings are priviledged. You have no grounds for anything.

If you have solid evidence that her accusations are untrue, submit that evidence to the court. What it will do- is destroy her credibility with the judge~ and help ensure that she does not limit your visitation due to the allegations.
