What is the name of your state (only U.S. law)? Alabama
My husband lost his job and we got into a bind. I contacted Bank of America and we got a forberance. Then we were trying to get our payments lowered. Long story short He got a job and I was visiting him I kept calling the bank did the right thing giving them our finanacials all that they said Dont worry were going to work with you give us a month and call back to see where you are in the system. I called 3 weeks later was told to call back in a month called two weeks later was told to call back then I got that wonderful letter that they were going to foreclose. I was so upset I called and the guy at te bank and he was like I didnt see that you called they he said oh here it is but it doesnt say you called to check on lowering your payments..Ya right. Happy birthday to me they auctioned off my house. Didnt give a chance to do anything the said they were working on lowering my payments and sold my house from under me. Can I take them to court. I have been so sick and upset over this and now because of this I have to file bankrupcy. Can I do anything at all

No you can't sue them. Well you can, but you won't win.
The renegotiation means nothing until it is signed. It doesn't necessarily (and usually doesn't) slow the foreclosure steamroller. They're under no obligation to consider such a deal anyhow, so you default, they follow the notice and publication rules for sale and the sale happens. That's the way it is.

so then its ok for a bank to string you along and then sell your house from under you? Even when you did the right things? I just dont see how this cana be fair

They aren't stringing you along. You are stringing them along by not making the payments you agreed to. Any accommodation they make is purely at their own convenience. You may have made all the right moves to try to get an accommodation from them, but they are never under any obligation to let you have it either through outright refusal or bureaucratic confusion.

well i would like to see you YOU figure that. I was TOLD not to make a payment untill they had modified my payments. I wasnt stringing anyone along. I was doing the right thing by calling and giving them our financials.And when a BANK tells you not to worry that they are going to help you out and then tell you that your loan is in modification and you will be getting paperwork then a week later sell your house.. Whos stringing who along? Answer that one by the way where did you get your degree from?
