MY LIVE IN A ILLEGAL APT WHICH I JUST FOUND OUT IN 1/01
I PAYED MY LANDLORD OVER 54 MONTHS IN CASH RENTIN WHICH I GOT A RECIPT. SUMMARY I GAVE ME NOTICE 60 DAY NOTICE TO MOVE. I TRIED HARD TO MOVE, BUT IT WASN'T FAST ENOUGH. SO HE SUED ME AND I SUED HIM. IVE BEEN HEAR 4 MONTHS OVER THE LIMIT THEN I PAY HIM RENT CASH. THE QUESTION IS DOURNING THIS TIME HE AND HIS WIFE HAVE HARRASED ME 34 TIMES
HE CALLED ME FKING JEW 2X CALLED MY WIFE A SPICK (IN PUBLIC)
THEY THREATEN ME 3X, MADE LOUD NOISES VERY EARLY ON PURPOSES
HARRASED US WITH CALLS AND INTHE STREET. I HAVE A POLICE COMPLAINT ISSUE AGAIST THEM. I HAD A MEDITIATION MEETING WITH THEM I SHOWED THEY DIDNT. THE LAST STRAW IS THEY HARRASED MY WIFE BECAUSE SHE DIDNT SAY HELLO TO THEM AND THEY SWONG A STICK AT MY WIFE AND NIMMED HER HEAD. PLUS IN THE PAST MY LANDLORD SAID TO US THEY WE CAN STAY THERE FOR LIFE AND NEVER RAISE OUR RENT. CAN I SUE HIM FOR CIVIL HARRASSMENT, SLANDER, AND BRAKING A VERBAL CONTRACT. Take the CAPS LOCK off and call an attorney. Assuming you have evidence - police reports, witnesses, etc of your landlord's actions, you may have a case. Otherwise, it is he said/she said and hard to prove.

Well if this is all true...ANY decent lawyer would take this on a contingency.....which is like personal injury the lawyer collects if you win.

I would call a good Landord/Tenant lawyer today..... i could give you a few phone numbers.

Of course if its an Illegal apartment the landlord has NO LEGAL right to collect any rent.....BUT the tenant cannot collect the back rent he has paid......

SO DONT GIVE THE LANDLORD ANY MORE RENT MONEY!.... Did you go to the Dept of Buildings 60 Hudson street 5th floor.....and get the Certificate of Occupancy? cost $5, it will tell you if the apartment is legal.

Plus if it is an illegal apartment... he CANNOT evict you in Housing court he has to file for "Ejectment" in supreme court which is expensive and could take 6 MONTHS...

BUT considering the harassment police reports, I would sue For ALL of the back rent...
