I live in Kentucky.

From 2013 to 2016, I lived in a particular apartment. After a year or so living there, my landlord revealed himself to be insane. He would start breaking into my apartment with his key and then physically assaulting me for no reason. He did this many different times. Once, he even brought a friend with him, and they both ganged up on me outside in the yard, but I fought them both off. The landlord never actually hurt me, not because he wasn't trying but because I was a better fighter than him. I moved out of the apartment in 2016. At the time he was attacking me, I had called 911 numerous times but the 911 operators I talked to were all uncooperative and refused to send the police, so I was never able to file a police report against him. However, during my fights with him, there were several people in the neighborhood who witnessed him fighting me, and even the situation where he and his friend ganged up on me. Since he was never formally punished for his actions toward me, I would like to sue him for assault. Is this possible?

He's posted this question all over the place, but apparently isn't happy with any of the answers he's receiving. No one is telling him what he wants to hear.

Keith502, the last times you visited the forum, the apartment you lived in from 2013-2016 had a mold issue due to an overflowing toilet.

Your landlord intended to hire professional cleaners but you told him you would clean it up yourself (which you did) - and then you wanted to sue the landlord for breathing problems you experienced later.

You followed up that thread with a thread that said: "I have recently come up with a new idea for how I could sue my landlord."

Excuse me if I find this latest story of frequent assaults by your landlord, and the failure of the police to respond to 911 calls, less than believable.

I suggest that, since you no longer have this landlord as your landlord and do not have to have contact with him, that you leave the fellow alone.

Kentucky has a one year statute of limitations for claims of assault. Kentucky Rev St section 413.140.

What long term, physical or financial damages have you suffered?
I have had no physical or financial damage from the attacks themselves. However, I have been going through some form of what I can only describe as PTSD from the memories of this maniac repeatedly busting through my door and viciously attacking me.

So you called 911 and told the call taker you were being assaulted and you were ignored, not just once but numerous times? Sorry, but that's very difficult to believe.
And nevertheless it's true. As a matter of fact, I have called 911 in other situations before I moved into the apartment and I still got the same response. It's a long-running problem for me.

The statute of limitations is the time within which you must file a claim. In your state for assaults, it is one year. You cannot file a lawsuit now. The time for you to do so is passed.

If in fact the police did not respond to several 911 calls, you could have at that time gone to the police department and filed your own report on the assaults.

You additionally could have filed complaints with supervisors against the 911 operators and/or department for failure to respond.

Threatening to kill your landlord is going to get your post reported. I think you should seek some help for your anger.

Actually, I don't think I should leave him alone. I think he is insane and he is evil, and such people should be dealt with rather than ignored. Frankly, I should have killed him when I had the chance, and I'm confident I would have had a legal basis on which to do so. I think I was incredibly merciful to let him live, and I don't feel he deserves any more mercy from me.
