Can I sue to get my money back?

What is the name of your state?

I just moved to Alabama last week.
Everything happened in California.
The other person just moved to Texas.

Last year and this year I have given my mother in law over $7,000.00 total to keep her house from foreclosure. She was begging for the money. Everytime I gave her money, I didn't get a letter or anything because she is my mother in law and I didn't think I would need to. She promised to pay me back. This was all while I was not living there, she just wanted help. I also had a car engine in her basement, that was sold online for $750.00. Since I was not there to make the transaction she said she would handle it and the guy gave her the money. Needless to say she has not given me any money. It has been several months and everytime I try to call her for the money she always hangs up on me while saying screw you etc.. In the process of trying to help her, and with her not giving us the money back on time, caused us to go negative along with other things. Do I have a strong enough case against her if I decide to sue? I have bank statements showing I gave her money along with a bank statement where I paid the mortgage company directly. The only thing I don't have proof of is her taking $750.00.. except for an online selling transaction. The only other thing I have is her son and daughter will testify that I gave her money. Can I take her to court?What is the name of your state?

Since you do not have a WRITTEN, signed contract, unless you MIL admits that the money was a LOAN and not a gift, you can pretty much kiss the money goodbye. All you can PROVE is that you gave her the money and paid some of her mortgage payments. You would need to PROVE that she agreed to pay the money back.

Did the mortgage company give you any receipt or paperwork that might indicate the payment was in relation to foreclosure? It's not clear from your posting whether you gave the mother in law cash or whether your check to the mortgage company took care of her obligation.

Unfortunately I never got any receipts. One time I paid over the phone directly to the mortgage company, the rest of the time I handed over personal checks to her so she could take care of it. I gave her checks because I was only giving her $1500 at a time and she was paying the rest.
