I have a 4yr old son whose father has never paid child support, has been in and out of jail for drug charges (felony convictions), cannot keep a job longer than 3 months (2 jobs in 2 yrs). Can I seek to terminate his parental rights due to him being an unfit parent, having never paid child support, no stable job and he rarely see's the child? Can his lengthy criminal background play a part as well? FL resident

Is there someone else to adopt ? Do you have sole custody? Are there any visitation orders in place ?

I am the custodial parent and there are no visitation orders. The father just doesn't seem interested in being a part of the childs life. I live w/ my parents and they are concerned that in the event of my death he would gain custody of my son, whom which he's done nothing for. There's no one else to adopt my son, I would just like to move forward and raise my son w/o the resistance of his non-supportive father.

If he is not around then where is the resistance ? Do you have joint or sole custody ? Unfortunately, you will not be able to remove his parental rights unless there is serious neglect or abuse direct to the child.
