What is the name of your state (only U.S. law)? Oregon
My father died after receiving care from medicaid. His house is being sold (also located in Oregon ) by the state to pay his property taxes and pay back medicaid bills. My brother, and a fellow heir, lives in Calif. and is on a full military disability. Does MERP apply? Can medicaid still recover their costs?

Yes. Their claim trumps junior's inheritance.


ETA: Why shouldn't Dad's estate be disposed of properly to pay his medical bills or to reimburse the state for he money they spent providing Dad's care?
