I don't know how to reply to a response, but I want to thank the person, "LegalBeagle" for answering my questions. I have been served. My ex, Mike, has served me with a petition to modify custody order. I have a lawyer, but she is too busy to help me it seems. Maybe I need a new lawyer, but she is allowing me to make payments, and no other lawyer would probably take my case on such good terms. My lawyer has spoken to Mike's lawyer once and he claims that Mike feels I am an unfit mother. He says Mike has many witnesses who can state that I am unfit. He also claims to having a stack of paper documents proving me unfit. I don't know what Mike feels he has. I have never spoken to anyone in his family since the children were born and they have never seen me in contact with my children. I have never even spoken to Mike's wife. I have many witnesses who will state that I am a good mother. I can't imagine what Mike has to prove me unfit. He has threatened about some recording, and I am positive I have been watched. Mike uses the children to control me. He never had any invovement as a father, and I was abused. I have a doctor's statement to the fact that I was hit, and reported the mental abuse well before Mike left me. My kids were ages 3, 2 and 2 when he left me. It was just before Christmas and we were being evicted. We didn't even have any Christmas presents. He refused to pay support until our divorce was finalized. He said that I wanted the kids so I should raise them. I have been divorced three yrs, and have never spoken a bad word against Mike. I don't want my kids to be afraid to go with him. He suddenly has expressed an interest in them and is hammering at me, because he is building a house. This is financially motivated. Mike knows I get to claim the kids as dependents this year and from now on. I have let him in the past, as I did not earn as much income and he might catch up on his back support. Anyhow that is my story in brief. Thank you for your advice. It is greatly appreciated.

Providing your attorney is not striaght out of college, you should be fine.. but make sure you document everything and gather any and all evidence. Ask your attorney about how to use your witnesses etc. Good luck, and let us know how it progresses...
