Part1
Recently my roommate refuses to pay the utilities because she said I have overcharged her rent. I am the tenant and only my name is on the lease, not her name. We had argreement verbally which how much she pays the rent, what are including in the rent(cable, living stuffs such as toilet papers, kitchen papers, ditergin for dishes, and light bult, I do cleaning the shared places(bath room, living room, living room)once or twice a week;she doesn't have to worry about cleaning and what are not, what we share (my whole dishes in the kitchen and my micorwave and what we pay half and half which is utilities. Then now she said under New York City Law, it is illegal to overhcharge a roommate for renting a room without the content of the leasing agent. She will not pay the utilities until I reimburse her for the overchargeing for her room. I am not sure what I overcharge her is wrong. I really would like know who is right.

Part2-after she insisted me
She noticed me the law of the City of New York will can claim me, sue me and let my landlord evict me if I don't pay her the amounts($500) of overcharging her back annd also I will must pay the three time of the amount. According to her and (her attorney?), the copy of the check she paied as one month can be a proof to make me pay her back, sue and evict me. Actully I talked my landord about her comaplaint and he will not consider and evict me, neither because my name is the only one on the lease and hers is not. Also he wants to make sure she will leave after this month beacuse he doesn't appreciate her living his real estate. (She noticed me she will leave after this march because she found new place).
Then I told her about what my landlord said and we had agreement vebally before you moved in ot my apartment. She said she has never had the agreement and even though my landlord will not evict me, my complaint will make the landlord evict me. She knows I have been reserching for this situaion and I have advice from couples of people who work law field (one of them is my friend who is attorney). Then she asked me give hee my friend's informations which are name, address, phone number. I believe her attorney and the court will contact me if she has attorney and hte attorney will fime her complaint.
I really don't know what to do. Some of my friends said wait until she will move out after this march, other said, move her stuffs out from her room and change the keys of my apartment. I really don't want to do anything which will affect criminal record and as the same time I want to get out this situaiton as soon as possible because teh situaiton has been really affecting my school work and work now. Please give me advice professinally and speciafically. I really appreciate.

#1 get rid of the roomate.......give her a 30 day notice to move and be out by April 30th.

Tell the roomate she is an LOSER for not having her share of the money....

Tell her the new roomate law, ONLY applies if It is in writing, and it only effects any new tenancy not existing ones.

And like ive said before.......people have been ripping off roomates for years here in NYC...its about time that a roomates gets a fair shake.

She cannot sue you for any overchage, and you really cant sue her for the utilities becuase NOTHING is in writng!

So forget about asking her for any money..just be happy when the bitchhh is gone......
