I have tried in good faith three times to negoiate with my spouse but to no avail. This person has cheated on me two times and is mentally and verbally abusive to the children and me. I have documentation to prove these allergations.
I guess I am afraid that the children would be given to her just because she is the mother.

Then force the issue.. get an attorney and file a petition in court for what you want.. You do not have to deal with her at all if you can not agree..
