Can Probation Officer serve subpeona?

I have a trial coming in a result of me being assaulted. I had two written witness statements from other parties, but my main witness, my ex, who refused written statement has now been sent 2 notices to appear with both being returned. My ex wasn't the one who assaulted me, it was his brother-in-law. My ex came to the station with me moments after the assault, and did speak with the officer about what happened. How he was one of the 3 men it took to pull him off of me. Luckily, that officer will be appearing as well.

What I wanted to know is, since my ex is on probation, can't they use that to serve him since that are declaring his residence vacant? I know he's living there, he's afraid to testify against his family.

There are probably lots of people who can legally serve subpoenas in Ohio.

If you do get your ex to court, he will have a memory lapse once he is under oath and on the stand.

You can never get in trouble in court by saying, "I do not remember."

Seen this happen approximately 7,921 times, more or less.
 
That's what I was afraid of. But if he appears, we also will have my witnesses and the officer to whom he spoke. I just thought it could work in my favor, and still put the opinion in the judge's mind that he's holding back information. I don't think he would lie on the stand, and that's why he's dodging the mail. I have had more trouble with his family than I ever have from him. (other than lack of CS and visitation)

I am meeting with a public defender today on a seperate case that spun off of the assault. My 'menacing'. I am hoping the dispatch records showing me calling the police first will show some sort of pattern that the group has been causing me harassment. I had no contact with the alleged 'victim' and her witnesses were the same parties there when I was assaulted. They have been trying to get me to drop the charges.I am putting my trust in the legal system without taking any plea bargains. Wish me luck! Thank you for your response.
 
Justice unserved

Well, while at the courthouse today, I went and spoke with the probation department about serving my ex with a subpeona that keeps coming back undeliverable. They told me that the other court has to be the one to serve him, and there was nothing they could do. I am not suprised, seeing how they let him go to bars daily, not work, not pay support, and break laws to get out of by being a confidential informant. I am pretty much losing faith in justice. If I had a chunk of money, sure I could make a difference with an attorney, but seeing how I am raising my 3 children on my own, that is far from a possibility. Childcare is taking a chunk, as well as just the necessities. This site has been my only true friend, and I wish I could take you to court with me to raise what points that need to be.
 
Not a double post again

Seperate cases, different issues, same parties involved in both cases. Are we paying attention, judge? (scary thought)
