Can she get child support?

My husband's ex-wife just had a baby. She asked him if it was ok for her to put his last name on the birth certificate eventhough the child was not his. She said that she didn't want her kids to have different last names. She also hasn't changed her name to her maiden name. My husband said that this would be ok, but can he be held liable for child support of this child?

If they were not married at the time of the birth and the child is not his then no.

Not so fast. In the State of CA, if he has done the above and has acted as father, (giving child support, vists, etc.), it is highly possible that he will the legal father. Look at CA child custody and parent cases.
