In south florida i have a situation where a city i believe has caused me and my family serious hardship. To make a long story short i had a cruise business snorkeling/sunset cruises. I bought the business from a man who bought it from the original starter. Anyway.. he expanded his boat from a 22 passenger to a 49 passenger. when i bought boat it was coast guard certified for 49 passenger. After buying i went to occupational license office with the city i was told it was only licensed by the city for 22 passenger. i complained and they said because of city parking rules there was not enough parking where i was leasing from to accomidate the other passengers therefore i had to abide by the 22 passenger rule( i have a copy of the occupational license) a few months went by and we had to close down our business and a big part of it was not being able to fill to capacity. We have been out now for 1 year the same rules are still in effect because i do have an e mail yesterday from occupational office telling me the rules and there the same. Now what i did find out the place i rented from they also had several other boating businesses there also and are still there but the city granted they full capacity on their occupational licenses i was the only one not to get it. I have proven thet the ordinance/law they quoted me about parking which is still current would mean all businesses are actually illegal because the hotel we leased from definately doesnt have enough parking for themselves let alone ANY boating businesses. Now the dock i had was opened up wider today by a local monopoly company that offers the same business i did except they will be bringing in a 129 passenger boat. The two docks mine and the one next to me had dividers removed by this company and hotel has allowed them to bring their 129 passenger boat in there within the next 10 days. The other businesses are still there that were there when i was ?
This city is known for this kind of stuff anyone wanting to see what i mean can google michael barnes duck tours. This attorney just sued the city a couple years ago and won a 13.5 million settlement because the city was favoring another big monopoly compaany in town and out a small guy out. There are a few differences in this case but also alot of similarities. Is it illegal for the city to cut me way down on my passenger capacity using the parking ratio and allow alot bigger company to take my space. If anyone has any ideas comments or suggestions
