I live in new york. about eight months ago i had a friend give me an old washer and dryer when i was moving into a new apartment. she gave me these items because she had new ones in her new house and she knew i was in need of these items so she offered them to me. about four months ago we we had a falling out, and now she wants to take me to small claims court for three hundred dollars for the purchase of these items. she is lying and saying she let me have them with the agreement that i pay her for these items. i never promised to pay her because it was never an issue. it was a gift. she is willing to lie in court and provide false witness to these alligations. will i be held liable for the money, and what are options for proving i never promised to pay for something that was a gift? any advice would be appreciated. thank you.

A1) No one on this forum can answer this one. We have no idea what evidence, if any, the plaintiff can bring forth to prove her case. Simply, if she doesn't have any evidence, she shouldn't win.

A2) Again, very hard if not impossible to answer. What you are asking is for some way to prove that a verbal agreement existed. I would suggest that you try to gather as much evidence as you can to support your case... or at least establish some accurate values in the event that she were to win.

Hi, I am also going through the same type of suit. Someone GAVE me something, and then changed their mind & DEMANDED GIFT back. So they are suing me. I picked up the Nolo Book
Everbody's guide to small Claims Court.
Most contracts are in writing. Look up on PC NY Civil Prac. Laws And Rules 201. Its Her word against hers... Good Luck I know its frustrating. You can file an answer also stating you denie her claim
thats its bogus.
