I purchased medical equipment for $20,000.00. The equipment delivered is almost twice as old as what I ordered. Age of the used equipment is not stated in the sales agreement. I am going to stop payment on the check and return the equipment. Is the law on my side??? I live in Arkansas, and the prestigious medical supply company I am dealing with wanted their money up front...they had to buy the equipment from someone else. The check has not cleared and no one in their right mind would give that kind of money for what was delivered to me. It is not fair market value at all. I think someone was cleaning their junk out of the warehouse and took advantage of both me and the supply company I purchased from.

My response:

I agree. Stop payment on the check. From now on, do everything in writing with the company, by Certified Return Receipt mail, ONLY. Explain what happened, and why you placed a stop payment on the check. Explain your position succinctly, and explain your PROOF of the age of the equipment AND why it is not worth the price paid. Further, inform them that you feel they too were duped, and that's why you're sending the merchandise back to them. Also, inform them that you would like to continue working with them, but that from now on, all equipment model numbers must be sent to you first to confirm the age of the equipment before any further deals are solidified.
