i live in sc. my tenant was inconvenienced for almost 30 days at no fault of her own and i agreed to waive one month's rent ($700). a month has passed and now she feels this was not enough and is withholding half the rent. she has been late paying rent for the past 7 months. she told a neighbor she will sue me for moving expenses if i evict. i don't want to bad mouth her, or list the reasons why i want to evict her, but we're both better off if she moves out. a real estate student told me not to accept her rent payment, to file the eviction in court for a fee, and request she vacate in 5 days. do i have enough to evict her and is it really this simple?

NO nothing is that simple you can give her notice but she wont move then you have to file for eviction in court get a court date and then if the judge evicts her, then if she doesnt move you will have to have a sherriff or marshall evcit her....

Does she have a lease? and you should refuse to accept the rent.

so its best to pay the money and hire a good landlord tenant lawyer....since you dont have a clue about who is the boss of your property.
