I am on probation for a non drug related crime, I understand that they can "U.A." me anytime they want too. Anyway, I have taken the precaution of having an independent third party do the testing at my own expense. It's common practice In my area for probationers to be required to call into the Uintah county drug court every day to learn which color(s) if any, are required to give a urine sample for testing. I was informed by mail that my color is "purple" April was the third month of my five years of probation and I have "failed" to come in for a U.A. twice now. (the first month I wasn't required to) the first time I was out of state with a travel permit and in the deserts of Arizona. I have not missed a single call in for the month of April, and at no time was Purple called. Now I keep a record of Which color(s) is/are called each day.
My probation officer has decided that I should have a 7:00pm curfew imposed to help me with this "error" on MY part. I work 2-3 jobs on any given day and often am not finished working until midnight. Is it legal for him to bar me from gainful employment?

A: Giving you a 7 pm curfew is not barring you from gainful employment.

Most days on average I'm at work as a roustabout by 6:30am Usually I've completed that days work and am back in town around 4:00pm I then start work at one one of the two construction jobs I have these are strictly part time and I'm often doing the work for the home owners. This does allow me a good bit of leeway, however noone will hire a contractor who cannot put in at least a half days worth of work. weekends are straight out of the question as I have to drive three hours each way to Saltlake City to attend my court ordered therapy sessions on Saturdays. In my area not even the grocery stores are open on Sundays.
Therefore a 7 pm curfew is effectively ending any chances for me to have a second job. Certainly I couldn't expect a more traditional employer to hire me to work only two and a half hours per day. not to mention the simple fact wages are based on a per hourly rate. this curfew takes away my ability to make the money I'm capable of. at no point is AP&P, the Court system, or my therapists going to stop asking me for the money owed to them simply because I am no longer working as many hours as I used too. Alright so maybe my probation officer is 100% legal in imposing this curfew... fine what if anything can I do to have it lifted. It is just a means to have me incarcerated when I can no longer pay my fines. Please help I'm trying like hell to do all this legally and aboveboard.
