Hi! I have a friend whois in a landlord/tenant situation and I had the law book for my particular state, but since I cant locate it, I wanted to get other opinions and a real legal answer.
She has lived in this complex for a total of (4) months and in October she went to court on a forcible detainer and a judgement was entered against her, she was given (5) business days to vacate or the constable would be called to take possession of the apartment. The (5) days was well past due and she entered into a written agreement with the lanlord to make payments on the monies owing. She has failed to fulfill that agreement, by missing the last payment. Legally can the lanlord call the constable on a well expired judgement to gain possession or does the landlord have to take her back to court, obtaining another judgement.? PLEASE HELP!!!
