What is the name of your state?What is the name of your state?Ga.
I plan to get married in two weeks. I plan to file my income tax seperate from my husband's. Can IRS take my earned income tax for back pay for his child support order for his other kids from a previous marriage? His check is garnished every week, but still owes.

File seperately, and keep all your premarital or inheritance assets seperate. If it is YOUR seperate tax filing it cannot be intercepted for his arrearage.

ACtually, they won't touch her PORTION if they file jointly.

Hon...your tax situation is far more complicated than you realize if you marry before January 1....If you want to claim EIC..then DO NOT get married before January 1.

I went through that same thing. I live in California though. I filed an injured spouse claim and they took my money still. I was told that if my spouse had more taxes taken out than I did that they would take my money to help pay for his obligation (child support). I couldn't even claim EIC if I filed separately.

If your husband was supporting his child, then you wouldn't be in the mess you are.
