A relative of mine is running for political office in the upcoming May primary election. Several years ago he was accused of sexual harassment and settled out of court. His political opponents know about the charges and are planning to use this against him in the form of a flier being sent to the homes of voters. Can they do this? Would it be considered slander or libel? Thank you for your help.

Thanks-- Do you think it would be helpful to have my relative send a letter from a lawyer to the opposition warning them to keep their facts straight and refrain from any false information??? Pennsylvania

Much worse has been published in political elections. YES. They can do it. Public figures are subjected to a lower standard of privacy than the average person. As a public figure, your relative, by virtue of running for office, has agreed that the public has the right to know. Nothing can be done unless they publish a lie knowingly. Truth is a total defense in libel suits.
