undefinedI live in the state of Illinois...

When a person files bankruptcy and their information is sent to a mortgage company or car dealership etc, are the employees of these institutions
allowed to discuss what they see with people outside of their work?

Is there a confidentiality or privacy act that needs to be followed?

Can a person be sued for breeching this?

Some of that information is a matter of public record and available to the public on line. Lending and financial institutions have access to this information as well.

Example:
If I filed bankruptcy and I know of someone who shared this information with their family members, can they do this?

I know of a person who filed bankruptcy under her maiden name and when it is posted in the paper under legal, I know it didn't give any information other than her name.
When a mortgage/car dealership receives or views the information they get all the details like addresses (which could put two and two together) etc.

My friend's ex friend saw this information and has shared this with others outside of her line of work.

Is this legal?

**A: it is perfectly legal to share public domain information ie. nformation available to the public. How many times do we need to tell you that?

Take your nice to people pills, maybe your god and us peeons need a little more explaining when you refer to "public". To me, that means by SS# is for public display also???

If it has not been made confidential, yes.

my name, address and ss# are displayed together? Isn't that a risk for
indentity theft?

What about the Bankruptcy Rules requiring Social Security numbers on court documents?
In September 2002 session, the Judicial Conference approved proposed amendments to the Federal Rules of Bankruptcy Procedures and the Official Bankruptcy Forms. The proposed amendments will implement the Conference policy on privacy and public access to electronic case files. Barring Congressional action these amendments will take effect at all courts by December 1, 2003. As a result of this decision only the last four digits of the SSN will be displayed on all reports. However, the full SSN can still be used to perform searches to identify debtors.
