What is the name of your state? Nebraska (divorce was in Kentucky)

My ex and I had a credit card for the last 3 years, it was in his name and I was an authorized user. He decided when he filed for divorce that he didn't want to be responsible for the payments. Apparently all my ex had to do was call the credit card company and tell them he knew nothing about it, that we were divorced (we weren't divorced at the time he called them, papers hadn't even been filed) and that I was using the credit card post-divorce. They canceled the credit card and dropped his name from it. I wasn't told about this until I got a bill in the mail, since it was now in my name and my credit is shot already they jacked up the interest rate and the minimum payments went from $175/month to $2100/month!!

Can the credit card company remove his name? I know I was an authorized user, NOT a responsible party. He knew about the credit card and we were still together while the credit card was being used.

Is there anyway to get his name back on there? The credit card company is being of little help.

two thoughts -- 1. file a police report and send it to the cc company -- 2. haul him back into family court for contempt

I realize they want their money, but who gave them the authority to pull his name off when he was the responsible party and I was just an extra name on there?

Can you explain to me how filing a police report would do any good? I can't figure out what they would charge him with...this seems like an odd response.

Also what would family court do? THere is no court order stating he has to pay the credit card, so how is he in contempt? He just lied to the CC company and stated we were divorced. I sent them a copy of the seperation agreement and the final decree to prove we were still married AND living to gether at the time the card was used.

THEY have the authority to pull his name off of any account THEY ISSUED.

However, as an AU, you had no legal liability for that account and they cannot just switch it to you because they feel like it !

That you were still married and living together means nothing, that does not make YOU liable for the debt as an AU. NE is NOT a community property state and neither is KY. He's the one committing fraud here, by lying thru his teeth to duck paying HIS bills.

If you want to fight this, you're going to have to be tough about it and file police reports, file complaints with the state AG, dispute their actions IN WRITING (and send everything certified mail), dispute the crap on your credit report. Try www.naca.net for a consumer attorney.
