Sure they can. All the creditors have to do is sue you in court and obtain a judgment.

I live in San Francisco, California. My last paycheck was garnished - my payroll office deducted $390.00 on a court order that my visa credit card company with Chase Bank obtained. I am filling out all these papers to ask the court for a "claim exemption", which is a reduction in the amount being garnished. The standard deduction is 25% of your net earning (NOT GROSS)! This is a first for me, so I was shocked!!!
