I was out with a couple of friends of mine and one of the people took a picture of me with his digital camera. Now he has posted that picture on a local forum without asking my permission. Everyone on the forum is saying that since he took the picture with his camera then he owns the picture and can do what he wants with it. They all keep talking about how celebrities get there pictures posted in magazines all the time. Whos owns the rights to this photograph? is it me because the picture is of me, is it the person who took the picture, or is it both of ours? please help.

My response:

The picture belongs to the photographer. You allowed the photo to be taken. As long as the picture is not being used to advertise a product or service, or given to a third party for such purpose, then there's no law being violated, and there's nothing you can do about it.

What's the big whoop, anyway?

not really any big deal, it was just a situation where we both thought we were right about situation. I was more along the lines just trying to prove a point rather then seek action. If your correct then i now have to go admit defeat
