Hi, I wrote about 3 weeks ago regarding the court date I didn't go to and being evicted 3 days later. (Mary Hartman was quick to say ha,ha about my ignorance in missing court)Okay, anyway.....We if you remember did not get all of our belongings out of the apartment. So I called yesterday to see what the amount would be to get our things. She said it is 800 and something dollars....and then called back to say it's also 200 and something more dollars for storing my property. Since she did not actually put it in storage but left it in the apartment she had to charge me a rate that is prorated as if I lived in the apartment. Ok...I understand all this but then she informs me that most of my stuff is still there but they had already gotten rid of some of it, basically all the dressers and as they got time they would be hauling off the rest such as clothing, and other misc. items. Now my question is CAN she do this???? And if I was being charged for the apartment then how the hell can she go in and take my stuff????? We were evicted on march 24th, did she not have to hold my stuff for any certain matter of time??? I was going to pay the $1070.00 basically because one of the dressers belonged to my ex-husband grandmother that has passed away and I felt obligated to return it to him. But now that the dresser is gone I'm not sure I want to pay them anything. I have to leave now, but I will be back on the computer later this afternoon, I will check for a reply. Please answer quickly if you help me, I'm being charged something like $25.00 more a day every day my stuff sits in there. THANK YOU

Well figure it out....how much was the judgment from the court, and how much do they want?

If you owe $1070 well you owe it....the money has to be paid if you owe a judgment, so they are holing your stuff, for payment...just like any pawn shop does...

So what did you do on March 25th? why didnt you rent a uhaul? and move it your self...

if its still in the apartment, then you owe rent on that apartment of $25 aday...just like a storage locker...

so whats your question?

First of all dj1 aren't you also known as my friendly
"I don't know crap about the law" advice giver Mary Hartman I dealt with last time I posted a question???? My question is if I'm being charged as if I'm renting the apartment then how can she sell my stuff?? If you rent an apartment the manager can not just go in and sell your stuff? Correct???? So if I'm being charged rent, she shouldn't be able to go in and get anything. And I still don't understand where my payment of $540.00 for last months rent I paid when I first moved in has been applied?!?!? If I paid a prorated amount for the month I moved in, then the 540. plus a 300 deposit. This was suppose to cover first & last months rent and a cleaning deposit. So when I didn't pay on March 1, where did the $540. go??? Why did it not cover the last months rent when I was told that's what it was for when I moved in????? Why am I being charged the 540 again???? and either way I still don't understand if I'm being charged to store my things then why didn't she freaking store them instead of sell them or whatever she did with them?????!?!?!?!?

First of all, your logic is bad.

You are not renting the apartment, you are being charged storage.

Next, Do you really think that all you have to do is for YOU to think about it, in order to understand what is right or wrong here?
