I am on the Board of a condo association in Texas. Recently, one of the units that is owned by an off-property landlord had some water damage as a result of a leaking roof. This has happened before and the Association has always taken care of the damages. This time the carpet in the unit got soaked. The association offered to pay for all repairs and the cost to dry out the existing carpet. The owners want the Association to replace the carpeting in the entire unit since this is not the first time something like this has happened, or they will bring a law suit against the Association. I maintain that we should not replace the carpet because it was already in need of replacement. However, we should offer to pay the owners the amount we would have to pay to have the existing carpet dried out. Do they have a case?
