I operate a small computer repair business in the state of Alabama. I recently stumbled across one of my competitor's (located in the same town as me) employees websites. This is a link to what he had to say about me, my partner, and our business:

My question is this: since this is on his personal site, can it still be considered libel? If you punch in the link above and read it, you'll see why I'm upset over it. First of all, I've never used duct tape to repair anything in a computer. Secondly, the website that he says looks awful and was designed by my company was not. That website existed as is, long before my company was formed. Finally, if I do sell used equipment to a customer, I make sure they know that it is used and offer it at a substantial discount. Anyway, it is possible that potential clients could find their way to his site and see this information, so I was wondering if there was any legal recourse that i could take.
Also, he claims that my company's website is infringing on the copyright of his employers website. That link is www.ballardcs.com.
My company's site is www.lmarepair.com.
While my company's site may look similar, I don't see how it is infringing (I spent a lot of time reading free tutorials online and coding this site). He claims that the names of some of the div commands in the code are the same as his. Some of them are, but this is purely coincidental, as they are generic names such as "navigation" for a navigation menu and "contentbox" for the part of the site which contains most of the content. Please let me know your opinion on these matters. Thanks.
