Can this be done??

After Katrina we had to take what wa available for housing, which was a 3 bedroom trailer.

We have finally settled with the insurance company and are in the closing aspects of buying a home.
Our lease is up Sept 1st, 2006. When we moved in the house wasnt int he best condition, but at the time was better than the hotel.

The landlord offered to replace the carpets before we moved in as they were quite nasty. But having 2 small children I opted not to have brand new carpet, as I was sure that stains would arise. And they did. We have cleaned it ourselves, renting a carpet cleaner. Carpets are in better shape than when we moved in but there are still stains.

When we did the walk through, I noted that the carpets were in bad shape, the hole in the wall, and the other misc. things that I noticed were damaged.

We have made numerous improvements to the home, for our convience, such as installing a dishwasher, that will be left behind, all with the landlords permission. As well as fixing most everything that was damaged, again for our convience. My husband did the labor and the landlord took Materials cost of the rent.

I think we should be entitled to our entire deposit back. When I informed the landlord that we were buying a home and was asking in general since we smoked, if she would require the walls to be cleaned in order for us to receive our deposit back. To which she informed me that they do not give deposits back as they use that money for cleaning costs.

If I cleaned the home as well as clean the carpets again, can she keep my deposit? Which is $700.00. Would using a camcorder to walk though the home and zooming in on a newspapers date, suffice in court should it go to that extreme that the home was cleaned?
