Can we sue?

What is the name of your state (only U.S. law)? north carolina

We bought a house in 2008 that was owned by a real estate agent. When we were looking at the house we noticed the front steps were cracking and caving in. The agent said that he would fix the problem. He had a crew pour new concrete over the steps and told us everything was fixed. Three years later our front porch started cracking and sinking again. We called a structural engineer out to look at the problem. Come to find out he came out on behalf of the realtor three years ago and told him that their were issues with the foundation that needed to be fixed. We were never told this info. He just told us the problem was fixed, but he really just covered it up. Can we sue him? The cost in fixing half the problem has already exceeded $2500.

I presume you were provided with a disclosure form that stated that whatever is a problem now was just fine then, right?

If so, I believe you can still sue. If I read the right statute of limitation (but not totally sure), it was 3 years from discovery of the fraudulent statement.

**A: the real estate agent is also held to a higher standard that a non real estate agent Seller. Time to talk to an attorney.
