What is the name of your state? pa

i am being sued in civil court for an unsecured credit card debt of $8.000. the collection agency says they can garnish my wages, sell my personal property, and seize all bank accounts. my question is what can they legally do the bank accounts are jointly held with my husband (not named on cc) and our house is heavily mortgaged w/no equity. what are my options thanks
 


Yes...

Yes, the could sue over a CC and if they win a judgement, they may be able to do some of the things the CA has threatened.

However, has a court case been filed at this point, or are they just threatening to sue? If yes, be sure and answer the summons and show up in court...if not, have you been through the debt validation process? Under the FDCPA, the CA must prove that this is your debt and they have the right to collect it. Just because you owed a credit card at some time doesn't mean these guys can hassle you over it...and, if they've violated any of the FDCPA rules, you can sue them...

First of all, wages can NOT be garnished in PA and if your house is deeded as 'tenancy by entirety' they can't touch it. They also cannot place a lien on real property for cc debt in PA.

They can go after your bank accounts, and they can go after any NON-exempt property. As long as your name is on the joint bank account, they can take that money and your DH would have to file for an exemption and the prove what part of the money was his.
