Cancellation Fee

Back on Jan. 27th we found a house that we loved and wanted to buy. We consulted our Apartment's leasing office and was told that as long as there is someone to rent the apartment there would be no penalty, but if no one was found we would have to pay a cancellation fee of $2340.00. We were also told that the leasing office would put our apartment back on the list as available and even if they found someone we would not have to pay the fee. This was also confirmed by the assistant manager. We then signed the termination form and bought our house. Now three weeks later, the Leasing Manager is telling us that we have to pay the cancellation fee even though we found someone to rent the apartment. According to the Manager, we were misinformed by the other employees. They should not have answered our questions and instead, directed them to her. Since they didn't and we based our decision on their responses, do we have to pay the cancellation fee?

I'd appreciate any advice.

Is it written in your lease? Did you keep a copy of the signed cancellation form? Did the new tenant sign a new lease or just taking over yours?

Write them a letter saying you owe no fees as the landlord DID NOT lose any money on the apartment, and if they persist you will take them to court.
