I filed for Chapter 7 in 1997. I received the discharge of debtor in 7/97.
I had two mortgages and the second mortgager sent a 1099 Cancellation of debt to me but never released the lien on home. While trying to refinance this year, I contacted the 2nd mortgager to make some arrangement to release the debt and now a collecton agency is after me for 37 thousand dollars. The original loan was for$40k and I paid 60K before going bankrupt. If they wrote off the loan, is it legal to come after me after all these years? No payment arrangement to collect debt was ever made-I just received the cancellation.
