We provide weddingg videography services, and our policy for a deposit is inorder for the client to lock in the date for their weddingg they must send a deposit.. We are now changing our policy that they have to send a deposit and the signed contract.
BUT... we do not have that in place yet... We have a couple that cancled their weding and wanted the deposit back... our contract says that deposits are no refundable and it can be aplied to another date up to on year. Well this couple never sent their contract back to us.. and when we brought up our policy and contract.. they quickly said there is no signed contract (by them) we sent it to them with our signature on it. They said well the way we look at it... is we did not hire you... if there is no signed contract. (I could tell what kind of client i was dealing with then) We had a verbal but they did not sign and return our contract. I recenlty told them that we would send half the deposit back and that we would still honor our policy if one of them gets married up to one year.. they said no.. "we want all the money back" the total is $300. If I refund them half that would be $150. They said ok, we will have our attorney call your attorney..
any advice?
do you think someone will take us to small claims over this?
do you think we should still refund half of the deposit that way we do not have $300 that they gave to us ... we will only have $150?
What should we do?
If they did take us to small claims court... they live in another state does that mean I have to go to that state? and how much does it cost them to go thru with this..?
