What is the name of your state? Tx

My Landlord has locked us out of our apartment and told us that she is not giving us a key to get in until we pay the rent. I know that she is allowed to change the locks but she must give us a key if we ask for one. Myself, my husband and baby have no clothes or anything. We went to the office today and showed her a paper that says that she must guve us access to our apt 24 hrs a day and she said that she is under some type of different thing because they are individual. I asked her for the name and number of her owner and she refused to give it to me. We have not been to court or even received an eviction notice just a notice to vacate. We intend to pay our rent and the late fees this Monday. Is what she says about being under something different because they are private or individual and not having to give us re-entry true? Please help.

yes i do have a year lease which is up in Aug and when i called the police they said they couldnt do anything that i had to talk it out with her. The papers that we brought to her was a notice that my dad faxed to me from the aparment property where he works... its a notice saying that they have changed the lockes but if we owe rent or not we are still allowed in our apartment. it is a paper that they are supposed to put on your door when they do change the locks
 
TX allows lock outs IF the law is followed. There should have been written notice of the impending lockout plus another notice at the time of the lock out. They must provide a key REGARDLESS of whether you pay rent.

You might have to go to the JP and get a writ of reentry if they continue to refuse to give you a key.

They can't pick and choose which part of the law they want to obey.

holy take the whey out of the buttermilk and stop the CHURN... Queenie this cannot happen, no matter how derelict the tenant is in their rent. EVEN IN TEXAS>>> for crying out loud.
This really chaps my buttermilk.... Queenofsands, I know you have a hubby that has a rifle in his Lexus and you still are a decent landlord but CHANGE YOUR STATE's laws give even the loser tenants ( who may not be losers by choice but by situation... ( have you heard of a thing called a hurricane!!) and do something!!! You are bright and wonderful and empathetic..

Eeks! What happened when the police arrived and found you folks without any clothes on?

Supposedly, the law was designed to force a face to face meeting with management on the off chance that the tenants didn't know they were behind on the rent and needed to pay.:rolleyes: Some tenants go ostrich when the going gets tough and ignore calls and notices. A lock out requires them to meet with management to get the key. The landlord gets to vent about deadbeat tenants, yada yada yada, make the tenants feel bad BUT and it's a big ol' but they must give the tenants a key.

For some reason, our poster's landlord has taken leave of her senses and will soon find out how much trouble she's in.

While the law is tough, it provides a remedy/damages in the event a landlord violates the law.

Might I persuade you to share a pitcher of margaritas as a show of true TX hospitality?

I still think Texas needs to work on their landlord/tenant stuff.... weird...Sorry Queenie... Here is a Lime???!!
